What are the 309/100 Visas?
The subclass 309/100 visa is intended for the partners and spouses of Australian citizens, permanent residents, and eligible New Zealand citizens. To apply for this visa, you must be outside Australia when submitting your application, although you can be onshore or offshore when the visa is granted.
Typically, applicants apply for the temporary 309 visa first, followed by the 100 visa after a two-year waiting period. However, couples who have been in a committed relationship for at least three years before applying—or two years with a child—can apply directly for the 100 visa, skipping the temporary visa step.
After two years from lodging your 309 visa application, you will need to submit additional evidence of your ongoing relationship for the 100 visa. This process will grant you permanent residency in Australia, but you must continue to demonstrate that you are in a genuine relationship.
Dependents on the 309/100 Visa
You can include children and stepchildren in your application. If a dependent is 22 years or older, they must prove full financial dependence on the sponsoring parent to be included in the visa application.
Health and Character Requirements
Both the applicant and any children included in the application must meet Australia’s health requirements for the 309 and 100 visas. This applies even if the child is not migrating with the applicant. Additionally, the applicant and any dependents aged 16 or over must meet the required character standards.
Visa Duration
Your 309 visa remains valid until the decision is made for the 100 visa. You can apply for the permanent 100 visa two years after lodging your 309 visa application. The 100 visa will grant you permanent residency, allowing you to live in Australia indefinitely.
Sponsor Responsibilities
Your sponsor (the Australian citizen, permanent resident, or eligible New Zealand citizen) must meet specific responsibilities for two years after you and any dependents arrive in Australia on the 309 visa. This includes providing suitable accommodation and financial support during this time.
